2 Collection, storage and use of the personal data of our business partners

In order to pursue business relationships with our partners (customers, suppliers, other business partners), we store personal data about them (e.g. e-mail address, postal address, telephone number, ...). The personal data we collect for this purpose are used within our company by the departments concerned with pursuing the business relationship. We process your personal data for the purposes of fulfilling the terms of the business relationship between you and ourselves. Such purposes include:

  • Preparing quotations for customers for the supply of goods and services
  • Calculating your individual prices
  • Internal processing of your order
  • Delivering the ordered product
  • Inquiries to our suppliers
  • Contractual negotiations
  • Clarifying all technical aspects of the products and services ensuing from the business relationship
  • Payment transactions
  • General business correspondence with you

Your data may be merged and stored with data concerning other orders, inquiries and business correspondence that you transmit to us through other means (fax, post, telephone, ...).

If needs be, we also enlist the help of service providers (e.g. logistics companies for shipping products or banks for handling payment transactions). We pass on your data to such third parties only to the extent required to accomplish such tasks (the legal basis of processing is Article 6, para. 1 b and f GDPR). Our legitimate interest in using service providers, such as logistics companies for shipping your products for example, lies in provisioning our services in the most efficient and effective way possible, and hence in the fastest and most inexpensive manner for you. Third parties that obtain the personal data of our business partners are under an obligation to comply with the data protection provisions.

We reserve the right to pass on your personal data to external service providers for the purpose of running a credit check in order to safeguard our legitimate interest in ensuring our payment claims are met (the legal basis of processing is Article 6, para. 1 f GDPR). We receive from such credit reference agencies information about your previous payment habits and credit rating. These data allow us to appraise our business relationship and are used by us to make decisions about  deliveries and to safeguard ourselves against payment defaults.

We store your personal data for the duration of our business relationship and/or in accordance with the statutory retention periods.

 

3 Collection and storage of usage data during visits to our online services.

You can visit our website without expressly disclosing personal data. Only the use of your complete IP address is required to transmit the data you retrieve from our website to your end device (the legal basis of processing is Article 6, para. 1 b and f GDPR).

We store your complete IP address for seven days in order to be able to initiate legal proceedings in case of cyber attacks on our IT infrastructure. In doing so, we are safeguarding our justified interest with respect to our IT integrity (the legal basis of processing is Article 6, para. 1 f GDPR).

For certain service areas of our website, we also require personal data. We use these data to furnish you with our services as described later on in this Privacy Statement.

 

4 Our website service providers and partners

4.1 External links on our websites: 

Our Privacy Statement does not apply to sites of other service providers or partners to which there may be links on our websites. We have no influence over compliance with the statutory data protection provisions by these third-party providers. You can find information on the data protection policies of the operators of such sites on the websites concerned.

 

4.2 Google Maps 

We use Google Maps on our website to help you with orientation. Google Maps is a service of Google Inc. We have no control capabilities over this service and do not receive any information from Google as to whether you exchanged map information during your visit to our site.

4.3 YouTube

We have integrated YouTube components on this website. YouTube is an Internet video portal that allows video publishers to post video clips and other users to view, rate and comment on such clips, likewise free-of-charge. YouTube permits the publication of all kinds of videos. Hence, both complete films and TV shows, as well as music videos, trailers or videos made by users themselves can be retrieved via the Internet portal.

The operating company of YouTube is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. YouTube, LLC is a subsidiary of Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

Each time one of the individual pages of this website, which is operated by the party responsible for processing and into which a YouTube component (YouTube video) has been integrated, is launched, the Internet browser on the IT system of the data subject is automatically prompted by the YouTube component concerned to download a display of the corresponding YouTube component from YouTube. Further information about YouTube can be retrieved from https://www.youtube.com/yt/about/de/. As part of this technical process, YouTube and Google are made aware of which specific page of our website is visited by the data subject.

If the data subject is logged in to YouTube at the same time, YouTube will recognize, when a page containing a YouTube video is launched, which specific page of our website the data subject is visiting. This information is collected by YouTube and Google and assigned to the respective YouTube account of the data subject.

YouTube and Google are notified, via the YouTube component, that the data subject has visited our website whenever the data subject is logged in to YouTube when they launch our website; this occurs irrespective of whether the data subject clicks on a YouTube video or not. If the data subject does not wish this information to be transmitted to YouTube and Google in this way, they can prevent such transmission by logging out of their YouTube account prior to launching our website.

4.4       Google Analytics

We use Google Analytics, a web analysis service of Google Inc. ("Google"), on our websites for analysis purposes. Google Analytics uses cookies, which allow the use of our websites to be analyzed. The information generated by the cookie about the use of our websites is usually transmitted to and stored on a Google server in the USA. However, because we use Google Analytics with the extension "anonymizeIP()" to ensure anonymous use of IP addresses, Google truncates your IP address in advance within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. The full IP address is transmitted to and truncated at a Google server in the USA only in exceptional cases. On behalf of Wieland Electric GmbH, Google uses this information to evaluate use of the websites for the purpose of compiling reports on the website activities and to provision other services associated with website and Internet use to Wieland Electric GmbH. The IP address transmitted by Google Analytics is not merged with other Google data.

Our website uses the analysis technology of wiredminds GmbH (www.wiredminds.de) to analyze visitor behavior. In this process, data may be collected, processed and stored and used to create user profiles under a pseudonym. These user profiles are completely anonymized wherever possible and practical. Cookies can be used for this purpose. Cookies are small text files that are saved in the visitor's Internet browser and serve to recognize such Internet browser. The collected data, which can also include personal data, are transmitted to wiredminds or collected by wiredminds directly. wiredminds is allowed to use information left through visits to the websites in order to create anonymized user profiles. 5          Use of our e-shop:

Only trade customers are able to log into our e-shop to purchase our products through our online distribution channel. We will request your personal data (name, e-mail address, postal address, telephone number) for this process too. To activate our e-shop functions, however, we will still contact you directly. The personal data you provide to us for this purpose are used within our company by the departments concerned with processing your inquiries. We will also use your personal data (such as name and e-mail address), which you have provided to us for registration in the e-shop or in other registration forms or which save about you as our business partner (see Item 3), for advertising purposes, unless you object to such usage. Any other details, such as your name for example, you supply are voluntary. This allows us to address you personally by name. In order to process the data during the registration process, your consent will be obtained by way of the double opt-in and reference will be made to this Privacy Statement.

This means, once you have subscribed to the newsletter, you will receive an e-mail from us asking you to confirm your subscription. The newsletter contains the latest stories from our company (new products, services, special offers, competitions, ...). Your data will be stored for as long as the newsletter subscription is active. You can, however, unsubscribe from this newsletter by clicking the link that appears in each issue or by sending us a message – without giving reasons – (info@wieland-electric.com) (= revocation of your consent).

The Internet should generally be considered an insecure medium. Therefore, please note that we cannot guarantee the confidentiality of normal e-mail correspondence via the links on our site and via other e-mail addresses of Wieland Electric GmbH.

10 Applications

You can send speculative applications or applications for advertised vacancies to this address. Please note that the e-mail correspondence to this address is unencrypted and the confidentiality of your data cannot, therefore, be guaranteed. If you wish your email correspondence to be encrypted, please contact info@wieland-electric.com.

We will use your application documents to contact you personally to assess your suitability for an employment relationship in our company and to complete the application process. (The legal basis of processing is Article 6, para. 1, b, c and f GDPR) For this purpose, your application documents will be stored in the HR Department and forwarded to the specialist department for the employment concerned.

If we are unable to consider your application at the present time, we will store your application documents for 6 months to allow consideration at a later date as applicable. Your application documents will be deleted at the end of this time, unless such deletion stands contrary to any of our other legitimate interests. Other legitimate interests in this respect include the burden of proof in proceedings pursuant to the General Equal Treatment Act (AGG).

If an employment relationship ensues, we shall place your application documents in the personnel file and store them for the entire duration of the employment relationship, as well as for any statutory retention periods going beyond this time (legal basis of processing is Article 6, para. 1 a, b GDPR, Section 26 BDSG [Federal Data Protection Act], para. 1, new version).

 

11 General data on legal bases, data deletion and storage period

11.1 General data on the legal bases

Insofar as we obtain the consent of the data subject for personal data processing operations, Article 6, para. 1, lit. a EU General Data Protection Regulation (GDPR) serves as the legal basis for the processing of personal data.

Article 6, para. 1, lit. b GDPR serves as the legal basis for the processing of personal data required to fulfill the terms of a contract to which the data subject is party. This applies also to processing operations required to implement pre-contractual measures.

Article 6, para. 1, lit. c GDPR serves as the legal basis insofar as personal data need to be processed to comply with a legal obligation imposed on our company.

Article 6, para. 1, lit. f GDPR serves as the legal basis if processing is required to safeguard a legitimate interest of our company or of a third party, and if the interests, basic rights and basic freedoms of the data subject do not outweigh the first-mentioned interest. 

 

11.2 General data on data deletion and storage period

The personal data of the data subject are deleted or blocked as soon as the purpose of storage ceases to exist. Data can be stored going beyond this time if so prescribed by the European or national legislators in ordinances, laws or other provisions under union rules by which the party concerned is governed. Data will be deleted even when a storage period prescribed by the standards mentioned expires, unless there is a need to continue storing the data for the purpose of concluding or fulfilling the terms of a contract.

You will receive, upon request, information about the data we store free-of-charge. Your right to information is based on Article 15 GDPR

 

12.2 Right to correction

You shall be entitled to correction and/or completion insofar as the processed data concerning you are incorrect or incomplete.

 

12.3 Right to limitation of processing

You are entitled to limitation of the processing of data concerning you. The prerequisites for and scope of this right are based on Article 18 GDPR.

 

12.4 Right to deletion

You shall have the right to have the data we store deleted insofar as the relevant prerequisites are fulfilled. The prerequisites for and scope of this right are based on Article 17 GDPR

 

12.5 Right to notification

If you have asserted your right to correction, deletion or limitation of processing against us, we shall be obliged to notify all recipients to whom the personal data concerning you was disclosed that such data have been corrected or deleted or that the processing thereof is limited, unless this proves impossible or involves disproportionate effort.

You shall be entitled to be notified about these recipients.

 

12.6 Right to data portability

You have the right to receive the personal data concerning you, which you have provided to us, in a structured, standard and machine-legible and interoperable format. You also have the right to transmit these data to another responsible party without obstruction by the responsible party to whom the personal data were provisioned. The prerequisites for and scope of this right to data portability are based on Article 20 GDPR

You have the right, for reasons ensuing from your particular situation, to file at any time an objection to the processing of the personal data concerning you, such processing being carried out pursuant to Article 6, para. 1, lit. e or f GDPR, this applies also to a profiling supported on these provisions.

We will cease to process the personal data concerning you unless we can show compelling legitimate grounds for processing that outweigh your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

If the personal data concerning you are processed in order to pursue direct advertising, you shall have the right to file an objection to the processing of the personal data concerning you for the purposes of such advertising; this shall apply also to profiling, insofar as this is connected to such direct advertising.

If you object to processing for direct advertising purposes, the personal data concerning you will no longer be processed for such purposes.

You shall have the opportunity, in connection with the use of services of the information society, irrespective of Directive 2002/58/EC, to exercise your right to object by means of automated processes for which technical specifications are used.

 

12.8 Right to revoke the declaration of consent under data protection law

You have the right to revoke your declaration of consent under data protection law at any time and without giving reasons. In case of a revocation, we will delete and cease to process your personal data immediately. The revocation of consent does not affect the legality of the processing carried out by virtue of the consent up until the time of revocation. 12.9 Automated decisions on a case-by-case basis, including profiling

You have the right not to be subject to a decision based solely on automated processing – including profiling – which produces legal effects concerning you or similarly significantly affects you. The prerequisites for and scope of this right are based on Article 22 GDPR

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the member state of your place of habitual residence, your place of work or the place of the alleged infringement, if you consider that the processing of personal data concerning you is in violation of the GDPR.
